Royalty Free vs Editorial
What do we mean by
"Royalty Free"?

Images from us may be used for advertising, promotional or editorial use, in which the images are not resold. They may also be used in Web design, multimedia presentations, reports, brochures, advertising, promotional materials, disposable packaging or magazines.

If you want to re-sell the images, for such things as clothing items, hard goods (such as mugs), book jackets, greeting cards, textbooks, non-disposable packaging (software, video or music) or other items specifically meant for resale, you must buy a high resolution version, prior to which you would be informed of any other limitations to its use.

Why RGB Format?

A CMYK image has a colour gamut which is suitable for printing to press. Various presses and paper combinations, compounded by such issues as dot gain, require different separations from RGB to CMYK. Rather than have the user converting a CMYK image back to RGB, selecting the correct setting and converting the image back to CMYK (losing colour at each stage of the process), we will provide the image in RGB, the format in which it was scanned. If you can provide us the printing details, and you are buying the high resolution version of the image, we will supply it to you in RGB and CMYK.

Digital Photography?

When a digital camera has been used, the specifics are included on the detail page of each image. All images have been processed using Adobe PhotoShop and Apple Aperture. Where no detail information is provided the image was taken with a Mamiya 645 and scanned.

"Model Release"

All the images have been photographed by S.A. Wager unless specified. The photos were taken in public locations and no images have been included of locations where photography was specifically prohibited.

Where there are individuals, either in crowd scenes or public displays, specific model releases WERE NOT OBTAINED. Where an individual is identifiable, EDITORIAL USE ONLY is legally permissible. This also applies to certain images marked clearly on the detail pages.

"Editorial" refers to the market where the images will be used - primarily books, magazines, and newspapers - and, to a lesser extent, to the style of photography that appears in these venues. We use the term editorial to distinguish it from other markets like corporate, advertising, general commercial, or fine art."

"The myth about Model Release

The rule of thumb is that editorial usage (book, magazine illustration) does not require a model release; but advertising, promotion, endorsement usage always requires a model release.

First, it helps to understand it from the photo editor's point of view:

... First Amendment rights and the knowledge that model releases are NOT required for editorial use.

Photo editors, by stating that they require a release, are in effect eliminating extra work.

... If they do ask for a release, it's usually because they are working on a project of a sensitive nature such as drug abuse, mental retardation, sex education, etc. In those cases, it would be appropriate to ask for a model or property release."
